Europos Sąjungos išorinių sienų apsaugos teisinio reguliavimo ypatumai

LTDisertacinis tyrimas atskleidžia Europos Sąjungos teisinio reguliavimo ypatumus Europos Sąjungos pasienio valstybėje. Tyrime nagrinėjami Europos Sąjungos pasienio valstybės pagrindiniai požymiai, apibrėžiamos svarbiausios Europos Sąjungos "pasienio valstybės" kategorijos nuostatos bei pateikiama Europos Sąjungos pasienio valstybės sąvoka. Disertacijoje atskleidžiami socialiniai teisiniai reiškiniai, darantys poveikį policijos ir Valstybės sienos apsaugos tarnybos tarpusavio santykiams įgyvendinant nacionalinio ir Europos Sąjungos lygmens migracijos procesų kontrolės, viešosios tvarkos ir visuomenės saugumo užtikrinimo funkcijas bei organizuojant nusikaltimų kontrolę. Atliktame tyrime formuluojami policijos ir Valstybės sienos apsaugos tarnybos Europos Sąjungos išorinių sienų apsaugos organizavimo teoriniai pagrindai, nagrinėjama jų įgyvendinimo būklė. Mokslinių darbų, nagrinėjančių pasirinktą disertacinio tyrimo temą, ypač lietuvių kalba, nėra. Moksline ir praktine taikomąja prasme ši tema sisteminiu požiūriu yra naujai viešinama. Tyrimo metu formuluotos naujos sąvokos ir kategorijos, įvertinta Europos Sąjungos išorinių sienų apsaugos teisinio reglamentavimo būklė, teikiami siūlymai dėl teisės aktų tobulinimo Lietuvoje, kaip Europos Sąjungos pasienio valstybėje, taip pat sudarytas policijos ir Valstybės sienos apsaugos tarnybos tarpusavio veiklos teorinis ir praktinis sąveikos funkcinis modelis.

ENThe thesis reveals the European Union regulatory features of the European Union border state. The study dealt with the main features of the European Union border state, sets out the core categories of the European Union “border state”, and delivers the concept of the European Union border state. The thesis reveals social and legal phenomena that affect the relationship between the police and the State Border Guard Service performing national and the EU level migration process control, public order, and public security functions and organizing crime control. The study forms theoretical framework for organising police and the State Border Guard Service work in order to ensure security of the European Union's external border, and examines the state their implementation. Research works dealing with the subject of the thesis chosen, especially in the Lithuanian language, are absent. In terms of scientific and practical application, this subject is systemically new. The study formed new concepts and categories, evaluated the state of legal regulation of the European Union's external borders, submitted proposals on improving legal acts of Lithuania, as the EU border country, and created functional model of theoretical and practical interactions between the police and the State Border Guard Service.
