The Protection of Lithuanian consumers against unfair contract terms

LTLietuva į Europos Sąjungą įstojo 2004 m. Šiame straipsnyje pateikiamos “Projekto dėl Lietuvos vartotojų apsaugos perkeliant į nacionalinę teisę Direktyvą dėl sutarčių nesąžiningų sąlygų“ išvados. Straipsnyje nagrinėjamas Lietuvoje veikiantis nesąžiningų sutarčių sąlygų kontrolės mechanizmas, funkcionuojantis pagal ES Direktyvoje įtvirtintus reikalavimus, perkeltus į Vartotojų teisių apsaugos įstatymą bei LR Civilinį kodeksą. Direktyvoje reikalaujama, kad Valstybių narių teismams ir administracinėms institucijoms būtų užtikrintos adekvačios ir efektyvios priemonės, siekiant užkirsti kelią nesąžiningų sąlygų vartojimo sutartyse taikymui. Direktyva įtakojo daug pozityvių permainų Lietuvos teisėje, tačiau ne visada buvo įgyvendinami siekiami rezultatai - subalansuoti sutartiniai santykiai su vartotojais. Nepaisant to, kad buvo sukurti mechanizmai panaikinti nesąžiningas sąlygas vartojimo sutartyse, tokios sąlygos vis tiek plačiai naudojamos. Europos taryba (ET) neturi pakankamai kompetencijos, kad galėtų užtikrinti, jog būtų laikomasi jos priimtų sprendimų, nei užkirsti kelią nesąžiningų sąlygų taikymui. Galimybė taikyti baudas asmenims, nesilaikantiems ET sprendimo bei Vartotojų teisių apsaugos įstatymo, pagerintų vartotojų teisių apsaugos efektyvumą. Pažymėtina irtai, kad Direktyvos įgyvendinimo efektyvumui kliudo ir tai, kad verslininkai prieš pateikdami sutartis vartotojams neprivalo pateikti ET jas įvertinti.

ENThe mechanism of protection is composed according to the EU requirements set in the Directive as the provisions of the Directive have been transposed into the amended Law of Consumer Protection (basically to the Art. 11, 12, and 13) and Art. 6.188 of the LCC. The Directive requires that courts or administrative authorities of the Member States must have adequate and effective means for preventing the continued application of unfair terms in consumer contracts. The Directive's impact has clearly been positive, but has not always achieved the desired result: the establishment of balanced contractual relationships between consumers and professionals. Regarding the implementation of the provisions of the Directive 93/13/EEC into national legislation several problems have been raised. Firstly, many complaints concern the same points of Art. 11.1 of the Law even after terms have been declared unfair. Despite the legal mechanisms created to encourage the elimination of unfair terms in consumer contracts, such terms continue to be used on a wide scale. The Council does not have enough authority to ensure compliance with its decisions nor to stop continued usage of unfair terms. In order to prevent similar cases the decisions of the Council should be public thus enabling access to them for both professionals and consumers. Doing so would also increase consumer information and education in this field.The remedies foreseen (amendment, abolishment, exclusion from usage, compensation for damages) do not seem to be enough. The possibility of issuing fines for professionals failing to satisfy Council's decision or infringing provisions of the Art. 11.1 of the Law repeatedly would increase the effectiveness of consumer protection. Another weakness of the implementation of the Directive discussed is the insufficient preventive influence as the Council is not obliged to provide a professional with the evaluation of the contract term before it is presented to the consumer. What is more, the possibility of entitling courts and/or the Council to adopt a decision extending the effects of the first judgment to other professionals in the same economic sector would also increase the protection envisaged by the Directive and by the national legislation.
