GMO produktų tiekimo į rinką reglamentavimas EB: valstybių narių teisė imtis apsaugos priemonių remiantis atsargumo principu

LTStraipsnyje nagrinėjamas vienas iš kontraversiškiausių genetiškai modifikuotų maisto produktų tiekimo į rinką reglamentavimo Europos Bendrijoje sistemos elementų - valstybių narių teisė imtis apsaugos priemonių remiantis atsargumo principu. Pirmiausia straipsnyje gvildenama atsargumo principo samprata genetiškai modifikuotų produktų teisinio režimo kontekste, o toliau analizuojant susijusią Europos Teisingumo Teismo jurisprudenciją bei lyginant ją su PPO ginčų sprendimo kolegijos sprendimu dėl EB biotechnologijų produktų režimo, nagrinėjama galimybė valstybėms narėms remtis atsargumo principu nustatant apsaugos priemones.

ENArticle is intended to analyse a particular aspect of Community GMO regime, namely if safeguard measures on GMO authorised at the Community level may be adopted by the member states on the basis of precautionary principle. After going briefly through the role of precaution in the European risk assessment and GMO authorisation and management, article analyses practice of both - ECJ and WTO dispute resolution bodies. It is claimed in this article that whereas ECJ has granted Member States although moderate but still some discretion in this sense with its Monsanto judgement, which at least theoretically allowed member states to base their restrictive measures on GMOs on precautionary principle, the post-moratorium EU regime together with interpretation given by the WTO Panel, virtually abolishes this possibility. Hence the conclusion is drawn that evaluation of precaution, i.e. of the appropriate level of risk societies of Member States may find appropriate to bear, has ultimately shifted to the EC level, whereby Community institutions now ought to be led by precautionary approach both in GMO authorisation procedure and their subsequent management.
