LTLietuvos pareigūnų ir karių socialinės apsaugos garantijos užima ypatingą vietą Lietuvos socialinės apsaugos sistemoje. Kariai ir pareigūnai kaip specifinė asmenų grupė, atliekanti ypatingą darbą Lietuvos valstybei, gali naudotis specialiomis papildomomis socialinės apsaugos garantijomis – valstybinėmis pareigūnų ir karių pensijomis. Šiame straipsnyje siekiama atskleisti reikšmingiausias pareigūnų ir karių valstybinių pensijų reguliavimo problemas, pareigūnų ir karių valstybinių pensijų santykį su kitomis socialinės apsaugos išmokomis.
ENIn order to guarantee special social security for Lithuanian officers and soldiers, in 1994 the Law on Officers’ and Soldiers’ State Pensions was introduced. These special state pensions for officers and soldiers have become a substantial segment of integrated system of Lithuanian state pensions as well as a part of the whole Lithuanian social security system. The paper "Pecularities of Officers’ and Soldiers’ State Pensions regulation" deals with the most relevant and controversial aspects of the officers’ and soldiers’ state pensions, reveals relations between these pensions and other social security benefits. Dealing with the topic Lithuanian legislation is analysed as well as the most significant ruling of the Constitutional Court of the Republic of Lithuania. Lithuanian state pensions for officers and soldiers play an important role in Lithuanian social security system. Besides, they have close relations with other types of state pensions and specific regard to Lithuanian state social insurance pensions. Taking into account the peculiarities of these pensions, it can be stated that state pensions for officers and soldiers create an appropriate level of social security to persons who performed especial work or service for the welfare of the state and thus might be seen as fully justifiable. However, these pensions are in necessity of more definite regulation – greater conformity with other state pensions or reforming to separate social security scheme organized specially for officers and soldiers.
