Profesinių sąjungų veikla ir socialinės partnerystės plėtra Lietuvoje

LTSocialinė partnerystė - tai darbuotojų ir darbdavių atstovų bei jų organizacijų ir kitų socialinių partnerių tarpusavio santykių sistema, kuria siekiama suderinti darbo santykių subjektų interesus. Socialinei partnerystei užtikrinti ir darbuotojų interesams tenkinti būtinos stiprios ir aktyvios darbuotojų profesinės sąjungos. Vienas svarbiausių žingsnių - socialinės partnerystės sistemos sukūrimas darbo rinkoje. Kiekvienoje šalyje ši sistema savita, bet joms visoms būdingi šie bruožai: samdomi darbuotojai demokratiniu būdu išrenka savo atstovus, pastarieji, remdamiesi teisine sistema, atstovauja darbuotojams pagal kolektyvines sutartis, užtikrindami, kad stipresnė šalis - darbdaviai - negalėtų pasisavinti visą sukurtą pridėtinę vertę ir kad visiems darbuotojams ir jų šeimos nariams būtų užtikrintas tinkamas, žmogaus orumo nežeminantis pragyvenimo lygis. Metodinėje medžiagoje skaitytojai supažindinami su asociacijų laisvės principu, jo įgyvendinimo sąlygomis Lietuvoje ir Europos Sąjungoje, t. y. pateikiama profesinių sąjungų atstovavimo darbuotojams proceso teisinė analizė. ENSocial partnership is a system of interrelationship among the representatives of employees and employers and their organizations as well as other social partners used to harmonize the interests of the subjects of labor relations. To ensure social partnership and meet the needs of employees, strong and active trade unions are required. One of the key steps is the establishment of a system of social partnership in the labor market. Each country has a unique system; however, they all share the following characteristics: employees democratically elect their representatives who on the basis of the legal system represent employees under collective agreements ensuring that the dominant part - the employers - cannot appropriate all the added value and that all the employees and their family members are ensured an appropriate standard of living. The readers are presented the principle of freedom of an association, the environment of its implementation in Lithuania and the European Union, i.e. the legal analysis of the process of a trade union representing employees is presented. The publication also presents the legal regulation of social dialogue. Individual forms of social dialogue are presented and analyzed: practical and legal significance of collective negotiations; possibilities of legal regulation of labor relations by collective agreements; causes of collective labor disputes and their solutions.
