Garantinis tiekėjas liberalizuotoje elektros rinkoje
LTStraipsnyje nagrinėjama viena konkurencinėje elektros rinkoje taikomų būtinų papildomų vartotojų apsaugos priemonių - garantinis tiekėjas. Pagal Europos Parlamento ir Tarybos direktyvas ir kitus teisinius dokumentus garantiniai tiekėjai konkurencinėje rinkoje paskiriami tik tuo atveju, kai esamas tiekėjas nebegali ar nebenori tiekti, o gyventojams ir smulkiesiems komerciniams vartotojams nėra taip lengva greitai susirasti kitą tiekėją. Tokiu atveju konkurso būdu turėtų būti paskirtas laikinas tiekėjas - tai ir būtų garantinis tiekėjas. Išanalizavus Europos Sąjungos (ES) dokumentuose nustatytus teisinius garantinio tiekėjo veiklos pagrindus, straipsnyje pateikiama pavyzdžių, kaip šis modelis taikomas įvairiose ES šalyse narėse, ypač išskiriant Airijos pavyzdį, kuris galėtų būti tinkamiausias Lietuvai. Aptarti Lietuvos elektros tiekimo veiklą reglamentuojantys teisiniai dokumentai bei mažmeninės rinkos funkcionavimo problemos. Pasiūlytas garantinio tiekėjo modelis bei jo įgyvendinimui būtinos Elektros energetikos įstatymo pataisos.
ENThe EU Electricity Directive (2003/54/EC) has laid down the foundations of the competitive electricity market development in the Member States, but it also foresaw various consumer protection measures. The supplier of last resort (SLR) is a tool which protects the consumers that otherwise might be unable to obtain energy on reasonable terms and conditions (first of all, residential consumers) in case of failure of their suppliers. Analysis of the SLR application in various Member States has shown that there is no common model of this supplier: some countries strictly follow the requirements of the Electricity Directive, while others have just simply allocated the obligation to supply to the incumbent supplier (or suppliers). Analysis of the Lithuanian legal framework defining the electricity supply system has shown an inconsistency of the present definition of the public supplier functions with the EU legislation. The SLR model has been proposed, its approval or selection procedure, principles of its operation are described, and the consequent amendments of the Law on Electricity are prepared.
