Bendrovės komercinių paslapčių apsauga : disertacija

LTDisertacijos tyrimų kryptis yra pramoninės nuosavybės objektų, t.y. bendrovės informacijos, saugomos komercinių paslapčių forma, teisinė problematika Lietuvoje ir pasaulyje. Bendrovės komercinių paslapčių apsaugos sampratos ir objektų tyrimas, tinkamo bendrovės komercinių paslapčių apsaugos modelio paieškos, teisinės atsakomybės taikymo ypatumai ir kiti tyrimo aspektai neapsiriboja teorinio lygmens analize, tačiau pasireiškia darbe pateikiamo tyrimo galimybe praktiniam pritaikymui. Darbe pateikiamas bendrovės komercinių paslapčių apsaugos tyrimas ir tyrimo pagrindu gauti rezultatai yra pirmoji Lietuvoje disertacija, kurioje formalaus teisinio reglamentavimo, teisinių doktrinų požiūriais yra analizuojami ne tik bendrovės komercinių paslapčių objektai ir jų apsauga, tačiau kartu atskleidžiamos bendrovės komercinių paslapčių apsaugos sampratos ir teisinių prielaidų teorijos, analizuojamas poreikis saugoti konfidencialią bendrovės informaciją komercinių paslapčių apsaugos forma, pateikiamas bendrovės komercinių paslapčių santykis kitų pramoninės nuosavybės apsaugos formų atžvilgiu, įvardijamas tinkamas komercinių paslapčių apsaugos įgyvendinimo mechanizmas ir konkrečios priemonės tikslui realizuoti. ENThe subject of the thesis is the legal problems, pertaining to objects of industrial property, i. e. companies’ information, kept commercial secret in Lithuania and in the world. The study of the concept and subjects of companies’ commercial secrets, searching for an appropriate model for protection of companies’ commercial secrets, particularities of application of legal responsibility and other aspects are not limited to the analysis of the theoretical level, but also manifest by the possibility of practical application of the study, provided in the thesis. The examination of protection of companies’ commercial secrets and the results of the examinations, provided in the thesis , are actually the first ever study in Lithuania, in which not only the subjects of companies’ commercial secrets and their protection are analyzed in terms of formal legal regulation and legal doctrines, but also the concepts of protection of companies’ commercial secrets and the legal presumption theories are revealed, the need for protection of companies’ confidential information in the form of protection of commercial secrets is analyzed, the relation of companies’ commercial secrets with regard to other forms of protection of industrial property is presented, the proper mechanism for implementation of protection of commercial secrets and the specific means for reaching the goal are identified.
