Atstovavimo teisiniai santykiai versle

LTAtstovavimo institutą reglamentuoja Lietuvos Respublikos civilinio kodekso nuostatos, kuriose įtvirtinti atstovavimo atsiradimo pagrindai, atstovavimo teisiniuose santykiuose taikomiems dokumentams keliami reikalavimai, atstovo bei atstovaujamojo teisės ir pareigos ir kt. aspektai. Atstovavimo institutas plačiai taikomas tiek santykiuose tarp fizinių asmenų, tiek privačiame, tiek ir viešajame sektoriuje. Pažymėtina, jog verslo teisiniuose santykiuose taikoma atstovavimo rūšis - savanoriškas atstovavimas, kuris įteisinamas tokių dokumentų kaip įgaliojimas, atstovavimo sutartis, pavedimas pagrindu. Išimtinai tik verslo teisiniuose santykiuose taip pat taikoma specifinė įgaliojimo rūšis – prokūra. Atstovavimo institutui iš esmės priskiriama ir prekybos agento veikla, tačiau komercinio atstovavimo normos yra specialiosios bendrųjų atstovavimo nuostatų kontekste ir taikomos tiek, kiek kitokių taisyklių nereglamentuoja specialiosios komercinio atstovavimo teisės normos.
