LTMonografijoje analizuojama Mykolo Römerio mokslas apie Lietuvos valstybingumą ir modernios visuomenės raidą, apie valstybės ir visuomenės santykius, grindžiamus visuomenės, jos socialinių darinių savarankiškumu, atskiros valstybės egzistavimo pripažinimu. Atskleidžiama Mykolo Römerio teisinės valstybės vizija, asmeninės pastangos ir indėlis, įgyvendinant teisinės valstybės idėją Lietuvoje. Pateikiama Mykolo Römerio mokslinių ir publicistinių darbų bei literatūros apie jį bibliografija. Dalis monografijos skirta amžininkų atsiminimams apie Mykolą Römerį. Leidinys papildytas Mykolo Romerio ir jo artimiausių žmonių bei giminės nuotraukomis.

ENThe introduction of the monograph indicates that Michael Römer was an extraordinary personality both by his contribution to science, society, state and by his chosen path of life which was in sharp contrast to the conventional practices of the Polish gentry representatives in Lithuania. M. Römer (1880-1945), after graduating from the Higher School of Law in St. Petersburg proceeded with his studies at the Ecole Libre des Sciences Politiques in Paris (1903-1905). On his return to Lithuania he was actively engaged in social activities, history and publicists writing. The years of his life which coincided with the existence oh the interwar Republic of Lithuania were marked by richness and high productivity: he held significant public posts, became professor of constitutional law at the Lithuanian (Vytautas Magnus) University and for seven years served as Rector of the university. The legacy of M. Römer is extremely versatile and abundant. He investigated and took interest in the problems of different branches of law and history. However, constitutional law constituted the main field of his scientific work. M. Römer was mostly influenced by the European, notably, French jurist theoreticians A. Esmein, M. Hauriou, L. Duguit and others. However, he did not step on a trodden path, rejecting what he considered as superficial or erroneous, his views representing the elements of liberal doctrine and social solidarity ideas. Alongside with the general teaching on state and constitutional law M. Römer was actively involved in the studies of constitutional law of individual countries and, naturally, of Lithuanian constitutional law.M. Römer’s scholarly achievements were noted and appreciated not only in the country but outside it as well. He was elected member of the Czechoslovak Academy of Science and Arts and International Institute of Revolution in France, corresponding member of the Romanian Royal Institute for Administrative Law. Most of his works have not yet lost their importance. Political and social views of M. Römer, his assessments of political and social phenomena also deserve a scrutiny of the investigators. M. Römer did not systemize these views in the way he did with the legal ones, however, their essence can be easily revealed from the scientific works in constitutional law, publicistic writing, his diary and the rich manuscript sources left by him. The contribution into science of one of the most distinguished Lithuanian scholars has not yet been fully examined and synthesized; works of generalizing character devoted to him - mostly single articles - are not numerous: in the conditions of Soviet occupation this was out of question since M. Römer, both by his scientific outlook and his social background and status in the society did not belong to the category of approved personalities, whereas, emigration authors were unable to produce any works due to the lack of sources. The present monograph is a collective effort at the generalization of the research of M. Römer’s scientific legacy and his outlooks, conducted by the group of researchers of the Lithuanian Institute of Philosophy and Sociology. Naturally, the work does not aim at giving a comprehensive assessment of his scientific merits (the latter, in essence, being hardly possible due to the versatility of the problems touched upon and the mere amount of the legacy). Therefore, it is an attempt at throwing some light on M. Römer’s views on some essential, in the authors’ opinion, problems of the state.The attention of the monograph is focused on three sets of problems. First, the system of M. Römer’s views on the statehood of Lithuania, typical of a historian. The remaining two sets of problems represent the rich scientific legacy of M. Römer in the field of constitutional law: one - on the attitude to the interrelation between the state and society, based on a very topical and modern recognition of independence of the society, its social units and individual existence; another - on the problem of the state of law (Rechts staat): the whole teaching of M. Römer on constitutional law is permeated by his respect for the law, the care of his teaching being the state under the rule of law; therefore, the monograph reveals the vision of M. Römer’s state of the rule of law (Rechtsstaat), his personal contribution in establishing the rule of law idea in Lithuania as well as an unidentified, however, a distinctly perceived antipode of a state of law in the Soviet state. The monograph is written on the basis of M. Römer’s published and unpublished (publicistic writing, diaries, etc.) legacy, archival sources. [...].
