Sutuoktinių turto teisinio režimo rūšys ir vedybų sutarties reikšmė

LTSutuoktinių turtinius ir asmeninius neturtinius santykius Lietuvoje reglamentuoja Lietuvos Respublikos civilinis kodeksas. Pagal Lietuvos Respublikos civilinio kodekso 3.81 straipsnį, sutuoktinių turto teisinis režimas yra dviejų rūšių – įstatymų įtvirtintas sutuoktinių turto teisinis režimas arba nustatytas tarp sutuoktinių sudaryta vedybų sutartimi.140 Įstatymų nustatytas sutuoktinių turto teisinis režimas atsiranda sudarius santuoką, o turtas, įgytas iki santuokos sudarymo, laikomas asmenine kiekvieno sutuoktinio nuosavybe. Tačiau tiek iki santuokos sudarymo, tiek jau sudarius santuoką, asmenys gali sudaryti vedybų sutartį, kuria apspręs turto teisinį režimą. ENProperty and personal non-property relations between spouses in Lithuania are governed by the Civil Code of the Republic of Lithuania. According to Article 3.81 of the Civil Code of the Republic of Lithuania, there are two types of matrimonial property regimes: the matrimonial property regime established by law, or the matrimonial property regime established by a marriage contract concluded between the spouses. The legal matrimonial property regime is established by law at the time of the marriage and property acquired before the marriage is considered to be the personal property of each spouse. However, both before and after marriage, persons may conclude a marriage contract to determine the legal regime of their property. Key words: spouses, property, legal regime, marriage contract.
