Summary / Abstract:

LTMonografijoje „Lietuvos Respublikos baudžiamojo kodekso Specialiosios dalies sistemiškumo iššukiai“ atliktas kompleksinis Lietuvos Respublikos baudžiamojo kodekso Specialiosios dalies sistemiškumo (vientisumo, suderinamumo ir nuoseklumo) vertinimas. Ištyrus Lietuvos Respublikos baudžiamojo kodekso Specialiaja dali, baudžiamaja teisekura, Lietuvos baudžiamosios teises doktrinos vertinimus ir pasiulymus, Lietuvos Respublikos Konstitucinio Teismo jurisprudencija, Lietuvos Aukšciausiojo Teismo ir kitu teismu jurisprudencijos taikant baudžiamuosius istatymus tendencijas, taip pat tarptautines ir Europos Sajungos teises, tarptautiniu teismu ir teisminiu instituciju jurisprudencijos itaka Lietuvos baudžiamosios teises specialiosios dalies institutams, padaroma išvada, kad butina rengti nauja Baudžiamojo kodekso Specialiosios dalies redakcija.

ENThe monograph research aim is, on the basis of the analysis of Lithuanian criminal legislation, international criminal law and EU legal acts on criminal law, criminal law issues of the jurisprudence of CJEU, ECHR and UN Human Rights Committee, also Constitutional Court and SCL jurisprudence, scientific publications, legal practitioners (judges) and scholars’ opinion, to determine whether the Special Part of the CC and (or) separate Chapters of the Special Part of the CC, within the time period of 1 May 2003 – 31 December 2020, preserved its systemic nature (integrity, compatibility and (or) coherence), and whether it is capable of ensuring the implementation of its basic tasks. The research had the following tasks: 1) to investigate the influence and significance of the international criminal law and EU legal acts on criminal law, the criminal law issues of jurisprudence of CJEU, ECHR, UN Human Rights Committee and Constitutional Court for the criminal legislation and the Special Part of the CC; 2) to analyse the provisions, the reasons and peculiarities of amendments and supplements of the Special Part of the CC and its separate chapters, and to identify legal regulatory gaps and shortcomings; 3) to analyse the jurisprudence of the SCL (rulings of the Senate of the SCL and summary-reviews of the Criminal Division of the SCL addressing the provisions of the Special Part of the CC, as well as rulings adopted by an extended panel of seven judges and a plenary session of Criminal Division of the SCL) and to identify the problems related to the provisions of the Special Part of the CC.4) to analyse Lithuanian scholars’ publications (PhD dissertations, monographs, scientific studies, articles, etc.) addressing the provisions of the Special Part of the CC, and to identify the problems related to the special part of the criminal law; 5) to survey and interview legal practitioners (judges of the Supreme Court of Lithuania, Court of Appeal of Lithuania and district courts) and scientists, to analyse their opinion and identify problems related to the provisions of the Special Part of the CC; 6) to summarise the results of the influence and significance of the international criminal law and EU legal acts on criminal law, criminal legislation, international and national court practice and science, and to evaluate whether the Special Part of the CC preserved its systemic nature (integrity, compatibility and (or) coherence), and whether it is capable of ensuring the implementation of its basic tasks. Moreover, if necessary, to prepare a draft amendment to the Special Part of the CC, or its separate chapters or articles.The main research hypothesis is that the system of the Special Part of the CC and the internal structure of the chapters of the Special Part with amendments to criminal legislation, which were determined by both objective and subjective reasons, were unbalanced, there are significant gaps and conflicts in individual chapters of the Special Part. The main sources of research are the international criminal law and EU legal acts on criminal law, Constitution of the Republic of Lithuania, Criminal Code and its amendments, adopted from 1 May 2003 till 31 December 2020, as well as other laws and implementing legal acts. Besides the legal acts in force, the amendment and supplement drafts and accompanying documents of the Special Part of the CC played an important role in the research. Other important research sources are the jurisprudence of Constitutional Court on the criminal law issues, rulings of the Senate of the SCL and summary-reviews of the Criminal Division of the SCL addressing the provisions of the Special Part of the CC, as well as rulings adopted until 31 December 2020 by an extended panel of seven judges and a plenary session of Criminal Division of the SCL that provide a new interpretation of legal norm and corrections of the current practice. Finally, the ECHR, CJEU and UN Human Rights Committee practice on the criminal law issues also played an important role in the research. [...].
