Proporcingumo principas Europos Arešto Orderio išdavimo ir vykdymo procese
LTŠis mokslinis tyrimas prisideda prie tyrimų, analizuojančių pagal EAO perduodamo asmens žmogaus teisių apsaugą EAO sistemoje. Moksliniame tyrime atliekama sisteminė žmogaus teisių įtakos EAO sistemos veikimui analizė atskleidžiant proporcingumo principo taikymo reikšmę EAO sistemai ir principo taikymo galimybes EAO išdavimo ir vykdymo procese. Įvertinama ar ir kokiu būdu žmogaus teisės drauge gali sukurti prielaidas supaprastintos asmenų perdavimo sistemos veikimui ir būti kliūtimi šios sistemos funkcionavimui, taip atskleidžiamas ir įvertinamas abipusio pripažinimo ir abipusio pasitikėjimo santykis. Analizuojama, ar ES žmogaus teisių apsaugos sistema teisminiame bendradarbiavime baudžiamosiose bylose gali užtikrinti tiek perduodamo pagal EAO asmens žmogaus teises, tiek supaprastinto asmenų perdavimo tarp valstybių narių sistemos veikimą. Vertinama kokią reikšmę bendroje ES žmogaus teisių apsaugos teisminio bendradarbiavimo sistemoje turi vienas iš perduodamo pagal EAO asmens žmogaus teisių apsaugos būdų – EAO atitikties proporcingumo principui įvertinimas. Šiame kontekste tyrime vykdoma proporcingumo principo, išduodant EAO, įtvirtinimo proceso, ES rekomendacinio pobūdžio teisinio reguliavimo ir Lietuvos teisinio reguliavimo bei instrumento taikymo praktikos analizė [VDU ETD].
ENThis research contributes to the scientific research analysing protection of human rights of a person surrendered under EAW within EAW system. Scientific research carries out a systematic analysis of influence of human rights upon the operation of EAW system, revealing the importance and role of application of the principle of proportionality to EAW system as well as the possibilities of applying the principle during the process of issuing and executing EAW. The question of whether and in what way human rights together can form prerequisites for operation of a simplified surrender system and obstruct the functioning of such system is formulated and solved, thus revealing and evaluating the relationship of mutual recognition and mutual trust. It is analysed whether EU human rights protection system in judicial cooperation in criminal cases can ensure both the human rights of a person surrendered under EAW as well as the operation of simplified surrender system among Member States. The importance of one of the methods of protection of human rights of a person surrendered under EAW- namely, assessment of the EAW compliance with the principle of proportionality - is assessed within the general system of the protection of human rights in judicial cooperation in the EU. In this context, the research presents an analysis of the process of establishing the principle of proportionality when issuing EAW, EU legal regulation (guidance document) and Lithuanian legal regulation and practice when applying EAW instrument.
