Interesų konfliktai viešajame sektoriuje

LTViešojo administravimo subjektų priedermė įgyvendinti įstatymų nuostatas, ginti bei saugoti viešąjį interesą. Straipsnyje analizuojama interesų konflikto situacijos samprata bei elgesio modeliai kaip išvengti ar teisingai elgtis tokio konflito metu. Pati savaime interesų konflikto situacija nėra neteisėta. Praktinė problema yra ta, kad viešojo subjekto tarnautojas ar pareigūnas, susidūręs su interesų konflikto situacija, nežino kaip toliau teisingai reikia elgtis. Tyrimo objektas yra interesų konflikto situacija. Straipsnyje yra atskleidžiama intereso konflikto samprata, apibrėžiama privataus intereso sąvoka, pagrindžiamas viešojo intereso prioritetas privataus intereso atžvilgiu. Taip pat, straipsnyje analizuojami deklaruojančio asmens veiksmai, vengiant interesų konflikto, deklaruojant savo ar artimų asmenų privačius interesus, nusišalinant nuo sprendimų priėmimo. Rašant straipsnį, buvo naudojami dokumentų analizės, istorinis lyginamsis, statistinis, apibendrinimo metodai. ENThe duty of public administration entities to implement the provisions of the law and to protect and safeguard the public interest. The article analyzes the concept of conflict of interest situation and behavioral patterns of how to avoid or behave correctly during such a conflict. A conflict of interest situation is not in itself illegal. The practical problem is that a civil servant or official of a public entity who is faced with a conflict of interest situation does not know how to proceed fairly. The object of research is a situation of conflict of interest. The article reveals the concept of conflict of interest, defines the concept of private interest, and substantiates the priority of the public interest over the private interest. The article also analyzes the actions of the declaring person in avoiding conflicts of interest, declaring his or her private interests or those of close relatives, and withdrawing from decision-making. When writing the article, the methods of document analysis, historical comparative, statistical and generalization were used.
