Summary / Abstract:

ENThe tasks of the paper: to explore the application of international and Latvian normative documentation to deals with real property; to study the form of deals with real property, the principles of plausibility and good faith and purchase in bad faith; to examine and analyse the judgements of the Senate of the Supreme Court of the Republic of Latvia; to evaluate an opportunity for the notaries to have the rights to initiate a deal with real property in the computerized Land Register in the form of notification. The revival of market economy pursued an aim – to take into consideration the immovable property not only as a physical object, but also the rights to own it and, most importantly, to ensure the legal regulation of deals with real property. Along with the number of proprietors, the number of properties which are not only hold in property, but are also alienated as a result of a deal increased. In these years, the problem of double alienation and the acquisition of real property in bad faith have become topical. The insufficient scientific development of the issue, contradictions, a need for the development of legislation and personal interface in similar controversies were taken into consideration when choosing the title for the Master’s paper. In this Master’s paper, the suggested solutions to the current issues will encourage positive outcomes, reducing threats to the participants of real property market in the deals with real property and ensuring faith in lawfulness of a particular deal.
