Summary / Abstract:
ENThe ombudsman institute is the most important 20th century constitutional innovation. Protection of the human rights and control of the government activities is also the task of administrative court. However the ombudsman has several advantages in comparison with the court. The ombudsman could become a “future court”. In the post-soviet society and legal system ombudsmen has a difficult task to find a new way for action, which was used to the “law of power” – legally based recommendations. Nevertheless there are some instruments how to improve the fulfillment of the recommendations of the ombudsman also in the post-soviet society. [From the publication]
